Can I sell my house after the bank has sent me a “notice of default” or lis pendens?

Yes, and hurry! Time is of the essence. The lender is letting you know that they have initiated a legal action In order to collect the past due balance. This legal action will give them the right to foreclose on your home. This phase is also known as “pre-foreclosure.”

Foreclosure is the process of the lender reclaiming the property from the borrower, who has failed to pay as agreed. A foreclosure usually remains on the borrower’s credit for up to 10 years.

Selling after you’ve gotten a notice of default will allow you to salvage your credit and capture some of the equity in the home.

The amount of equity in your home will depend on a variety of factors, including how much is in default, your remaining balance on the mortgage and current ARV. (After-repair Value)

I’ve just inherited my uncle’s property- Now what?

First, condolences to you and your family. Second, is the home vacant? Is a family member living in the property? Third, determine the highest and best use for the property. My wife wants a divorce. What should we do with our home?

It depends. Do you have young children? In some instances the judge will award the custodial parent the home, in others it may be best for the couple to sell the house and split the proceeds.

What if I owe more on my mortgage than my house is currently worth?

This is often the case, depending on what type of mortgage you used for financing. In some instances, we may be able to negotiate a short-sale with the lender.

In a short-sale, the lender has to agree to accept less for the mortgage than originally agreed upon.

What happens if I inherit a property that has a pending foreclosure?

You inherit the debt and will need to get the mortgage caught up in full, in order to stop the foreclosure.

Can I lose my house if I don’t pay my property taxes?

Sure can. Property taxes are due every year and if not paid, after a couple of years, an owner risks losing their home in a tax deed auction.

Can I keep my property after I file bankruptcy?

Bankruptcy, can be a little tricky. There are several factors that the Bankruptcy courts will consider. What type of bankruptcy did you file? How much is your overall debt? How much of your property contributes to your debt? Oftentimes, the homeowner will be required to sell their property in order to pay off other creditors.
